If there's a good reason, such as preventing VC game piracy and hacking that gives an unfair advantage to players, then I'd say it's perfectly valid. However, if it's merely for having unauthorized software on the Wii, then yeah, I'd say that's a little too far. As long as it doesn't cheat Nintendo out of money, which is what I'd imagine most people with modded Wiis try to avoid anyway, then it's none of Nintendo's business what you do to your Wii.

That said, playing B+ or BB online is perfectly safe because (1) no one really looks online at friendlies between friends to see what's going on; and (2) from the players' points of view, the worst that can happen, and likely will happen in Brawl with Anyone, is a desync. To someone unfamiliar with the concept of hacked games, it would only look like the opponent is stupidly jumping off the stage to his/her death repeatedly.

You can make him permenetly hold a beam sword then replace it with his sword so he uses it. That's what I did!
